Terms of Service

1. Acceptance of Terms

By downloading or using the Splashy Sketchpad application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. License

Splashy Sketchpad is licensed, not sold, to you by Aftaab Siddiqui for use strictly in accordance with these Terms and the usage rules established by the Mac App Store. We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal or commercial purposes strictly in accordance with these Terms.

3. Restrictions

You agree not to, and you will not permit others to:

• Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App.
• Make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App.
• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of Aftaab Siddiqui.
• Distribute, sell, lease, rent, lend, or sublicense the App.

4. User Content

You retain all rights and ownership to any artwork, drawings, or content you create using the App. We claim no ownership over your creations.

5. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Limitation of Liability

In no event shall Aftaab Siddiqui be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
